mental health laws in virginia.?

a family member of mine is mentally ill and she has been temporarily checked into a hospital (for two days). the court date for her is tomorrow and being that she is over the age of 18, she has the right to leave after tomorrow and never come back, basically. my question is this: is there any way that we, her immediate family, can possibly plead the case that she is mentally ill and despite her age, make her mother still her legal guardian? she is not classified as "ill" and after the court date the entire family is worried that something bad will happen. i just want to know the rules, thank you.

You would need to petition the court for the appointment of a guardian or conservator. An attorney could definitely help you with this process, and increase the chances of success. Your local Community Services Board (a list is available from the DMHMRSAS web site) may also be a valuable resource.
